Subscription-based companies are constantly building on strategies to capitalize on interactive influencer campaigns, stream engaging content, and capitalize on free trial and automatic renewal programs. What many don’t realize, however, is how highly regulated the legal landscape surrounding the advertising and retail industries is – and how these laws apply to the arenas of e-commerce, digital marketing and social media. The Federal Trade Commission (the FTC) is hyper-focused on the subscription economy, and can seek incredibly high penalties and consumer redress in the event of companies’ non-compliance with its rules governing subscription sign-ups and cancellations as well as influencer marketing and celebrity endorsement disclosures. Further, companies streaming content need to be aware of the complex intellectual property landscape when negotiating clearances and licenses. This discussion will address these legal minefields and upcoming changes to the law that all subscription-based companies need to be aware of to avoid becoming the regulators’ next target.
