Session Overview

Post-employment restrictions are under attack at the federal and state level. The proposed FTC rule, recent guidance from the NLRB, as well as new and proposed state laws, have employers questioning how they can implement and enforce post-employment restrictive covenants. Despite this challenging legal landscape, there are still steps that employers can take to protect their most critical interests, confidential information, business relationships and assets.

Topics to be covered include:

  • The current status of the proposed FTC Rule and New York State non-compete legislation seeking to ban certain restrictive covenants
  • The impact of the NLRB General Counsel’s recent memo concerning non-competition agreements
  • Ways in which employers can implement and enforce restrictive covenants in a lawful and compliant manner, and other strategies for employers to protect their legitimate business interests
  • Why “one-size-fits-all” is not the best strategy, and the factors employers need to consider when preparing agreements with post-employment obligations
  • An update of important legal developments affecting employee benefit plans and plan fiduciaries
