Maryland is enforcing new strict children’s privacy laws aimed to protect children and teens online. The “Maryland Kids Code” which went into effect on October 1st, has restricted how businesses can collect and process data of those under 18. Davis+Gilbert Privacy, Technology + Data Security partner Gary Kibel was quoted in a recent Bloomberg Law article discussing the requirements and scope of the Maryland law.
To ensure compliance, Gary warns that “businesses need to have a frank discussion internally about whether minors are accessing their services, even if they aren’t the primary audience. The law includes significant legal requirements and makes targeted advertising to those under 18 nearly impossible.”
