2022 Innovating Commerce Serving Communities U.S. Law Conference | Respect and Dignity in the Workplace – The Intersection of Privacy and Retail – Lease Remedies Post-Covid

Gregg Gilman, Davis+Gilbert Labor + Employment partner/co-chair, Gary Kibel, Davis+Gilbert Privacy + Data Security partner and Jesse B. Schneider, Davis+Gilbert Litigation + Dispute Resolution partner will speak on three workshop panels at the 2022 Innovating Commerce Serving Communities (ICSC) U.S Law Conference on October 26 – 28.

Gary Kibel will speak on a panel titled “The Intersection of Privacy and Retail:  Compliant Data Collection and Use” on October 26. This workshop will provide an overview of the privacy issues which companies need to address in their businesses, including online and offline data collection and processing. They will dissect how these privacy issues are addressed in the acquisition, creation, implementation, and operation of businesses, with a case study on how these issues have been addressed in three different businesses, Stretch Zone (practitioner assisted stretching concept), New Standard (Cannabis dispensary) and Essex Title (title agency focusing on commercial transactions and operating nationwide). The presenters will address how privacy laws have changed the way businesses operate and provide insight on the future of privacy and the impact on business operations.

Jesse B. Schneider speak on a panel titled “Lease Remedies Post-Covid: May the Force (Majeure) Be with You” on October 26. This workshop will focus on appellate courts’ interpretations of various force majeure clauses and their holdings concerning challenges to the enforceability of personal guarantees that have arisen under “Guaranty Laws” in states such as New York. The presenters will also discuss how Landlords and Tenants can best protect themselves moving forward in the post-Covid landscape.

Gregg Gilman will speak on a panel titled “Respect and Dignity in the Workplace: How to Prevent a Toxic Environment” on October 27. This workshop will discuss the best practices for employers to prevent and address harassment in the workplace, whether based on sex, race or another protected class, especially given today’s new remote paradigm. Using real-world examples, the workshop will offer practical insights to help companies avoid not only the significant legal consequences that can accompany unlawful harassment but also the damage to employee morale and retention that can be even more difficult to overcome in the time of the Great Resignation.
