AdExchanger | Don’t Sleep On Maryland’s Strict New Data Privacy Law

Numerous states have enacted their own comprehensive data privacy laws the California Consumer Privacy Act in 2018. Keeping up with the differences between these laws can be a challenging task for any business or privacy professional. Maryland’s new privacy law, The Maryland Online Data Privacy Act (MODPA), which goes into effect on October 1, 2025, is among the strictest in the United States.

Davis+Gilbert Privacy, Technology + Data Security partner Gary Kibel was quoted in this AdExchanger article, “Don’t Sleep on Maryland’s Strict New Data Privacy Law.”

In the article, Gary discusses the MODPA, and its strict prohibition on the sale of sensitive personal information. Gary emphasizes that Maryland’s law is unique because it completely bans the sale of sensitive personal data. Gary comments: “As drafted, you can’t even sell sensitive personal information with consent from the user!”
