Session Overview
When advising clients on advertising matters, you may encounter ethical dilemmas that require careful judgment. Through a series of hypothetical scenarios, learn how to steer clear of common ethical traps. After completing this session, participants will be able to:
- Outline best practices for preventing ethical problems when reviewing creative content and factual claims in ad campaigns
- Determine whether you may use AI tools in representing a client in bringing or defending an advertising challenge
- Advise clients about when they may destroy and when they may preserve creative files for risky ad campaigns
- Understand how far they can advise clients about impermissible advertising activity, without unethically participating in that activity
- Ascertain whether they may ethically represent a client in challenging (or defending a challenge against) a current client, a related client, a former client, or a prospective client
- Determine whether they may ethically publicize their representation of a client
- Understand whether they may ethically perform legal work for clients located outside the jurisdiction(s), and whether they may perform such work when they themselves physically located outside the jurisdiction(s) in which they are admitted to the bar
