Session Overview

As part of the Practicing Law Institute’s annual Advertising Law Institute, Ashima Dayal (Partner, Advertising + Marketing) and Paul R. Tremblay (Clinical Professor of Law and Law Fund Research Scholar, Boston College Law School) will lead an “Ethical Issues in Advertising” session. The session will explore the unique ethical considerations that can arise when counseling clients on advertising matters, using a series of interactive hypothetical scenarios to illustrate how to avoid common pitfalls.

Key discussion points include:

  • Best practices for preventing ethical problems in ad campaigns
  • Appropriate communications between opposing parties and issues around minimizing a client’s readiness to settle
  • Ethical subtleties between disclosure, omission and outright deception
  • Avoidance of ethical errors around exaggeration of case strength
