While all industries are subject to the general principles of advertising law, some industries – most prominently alcohol, cannabis, gambling, and tobacco – have unique regulatory considerations for anyone advertising (or accepting advertising for) such products. With compliance already being a complicated proposition, 2025 has seen dramatic regulatory shifts, especially for gaming and cannabis, that will certainly turn 2026 on its head. 

This Briefing will discuss legal compliance and recent developments in the following areas:

  • Alcohol, with a focus on recent decisions by the Distilled Spirits Council of the United States
  • Marijuana and CBD, with a focus on President Trump’s executive order rescheduling marijuana and legal challenges for the hemp THC space 
  • Gambling, with a focus on prediction markets, sweepstakes casinos, and pick ‘em fantasy sports
