Session Overview
This American Conference Institute event will equip attendees with the tools and techniques they need to meet the legal and regulatory challenges the food industry is now facing — as well as those to come. During this dialogue session, Ronald Urbach (Partner/Co-Chair, Advertising + Marketing) will moderate a conversation between two fellow industry powerhouses: Laura Brett (Vice President, National Advertising Division, BBB) and Serena Vishwanathan (Associate Director, Division of Advertising Practices, Bureau of Consumer Protection, FTC). This critical discussion will center on how both the newly-updated FTC Endorsement Guides and proposed rule on consumer reviews and testimonials will impact social media advertising of food products — both currently and moving forward.
Key discussion points will also include:
- Analyzing the FTC’s guidance for social media on influencers and endorsers
- Understanding FTC’s take on dark patterns and consumer deception tactics
- Examining problematic claims and areas of NAD and FTC focus
- Addressing compliance challenges when advertising across different social media platforms, including: Metaverse, Instagram, Facebook, X, TikTok and YouTube
- Substantiating claims in advertisements
- Assessing recent FTC enforcement actions
- Discussing potential penalties for misrepresenting a food product to a child
