Session Description
This segment will provide instruction on building a commercial lease with a focus on critical provisions. After completing this session, participants will be able to:
- Assess the current leasing market
- Weigh the landlord’s and tenant’s respective negotiation goals
- Negotiate primary work letter issues, including:
- Shifting the liability risks
- Fairly determining the date of substantial completion in a landlord-build lease
- Addressing delays by the landlord in a tenant-build lease
- Who bears which construction costs and when payments should be made
- Negotiate certain tenant option provisions such as expansion and contraction options
