In recent months, new developments in generative artificial intelligence (AI) have been emerging at breakneck speed—captivating the curiosity of consumers and agencies alike. While tools like ChatGPT, DALL·E 2, Bard, Midjourney and more create a world of opportunities, they also introduce a host of pressing legal and practical risks. In this session, Samantha will cover how these new technologies—built on machine learning algorithms—could fundamentally change the communications and marketing industry and share best practices for considering their usage as business tools. Examples of actual AI prompts and resulting output will be analyzed to understand how to use these tools while minimizing potential legal liabilities and infringement claims. Discussion will also include how client contracts should be adjusted to take into account the use of generative AI.
