Whether launching a new brand or product line, drafting and negotiating a wide range of commercial agreements (including licensing and collaboration agreements, talent and influencer contracts, sponsorship deals and production agreements), or handling contentious matters such as responding to a class action or resolving a trademark dispute, our team delivers practical judgment backed by deep industry knowledge.

In today’s social-driven marketplace, we counsel clients on the front end of risk, designing compliant promotions, auto-renewal programs, and influencer campaigns, while also securing rights for user-generated content and licensing agreements. When regulators such as the FTC, FDA, NAD or state attorneys general challenge advertising or claims, we represent brands throughout investigations, disputes and negotiated settlements, leveraging our strength across advertising, privacy, product safety and intellectual property.

The team clears and secures business names, brand names, designs, and logos, ensuring that new launches and creative assets are protected from the outset. Representative Experience

  • Represented a luxury beauty brand in a first-of-its-kind partnership with the iconic cheer team of a professional sports franchise, advising on the structuring of intellectual property rights within a highly regulated league framework and shaping the development of compliant marketing activations for both retail and in-stadium promotions.
  • Provide ongoing licensing, retail advertising and entertainment counsel to a leading teen and tween fashion and accessories retailer. Our work spans traditional and immersive platforms, covering IP clearance and enforcement, vendor compliance, pricing and promotions review, retail advertising strategy and subscription offering structuring. Also advised on the launch of a branded Web3 experience, addressing trademark, copyright, data privacy, gamification, influencer engagement and digital marketing disclosure compliance.
  • Advised a major fashion brand on its highly anticipated return to New York Fashion Week, providing comprehensive legal support for the runway show. Scope of work included IP clearance, music licensing, negotiating live streaming rights, negotiating model and stylist agreements, and providing guidance on social media posts and other usage rights for content featuring event photos and videos.
  • Advised a major fashion brand on a long-term strategic design partnership with a European football legend and his licensor for a signature clothing line. Negotiated and drafted a bespoke agreement to support the deal’s complex structure.
  • Secured a victory on appeal preserving industry-accepted performance-testing methodologies for a leading cosmetics client, avoiding costly changes to claim substantiation standards.
  • Management of the U.S. and international trademark portfolios of a luxury lifestyle brand, overseeing trademark clearance, prosecution, registration maintenance and enforcement actions, as well as industrial design and copyright protection.
  • Represented the estate of a globally known rock icon in an action over unauthorized use of the artist’s persona and trademarks on a sneaker line, achieving protection for the estate’s merchandising and licensing program.
  • Management of the U.S. and international trademark portfolio of a well-known fashion brand, overseeing clearance, prosecution, registration maintenance and enforcement actions.
