Session Overview
This panel will address the evolving and challenging issues that involve gender, gender identity and expression, equal pay, and related issues that are shaping workplaces in 2026. After attending this session, participants will be able to:
- Analyze the Administration’s and EEOC’s position regarding the continued application of the Supreme Court’s Bostock precedent
- Evaluate the impact of federal guidance and enforcement priorities following the Administration’s Executive Order on “Defending Women from Gender Ideology” and related policy shifts
- Review emerging trends in pay equity litigation, including class actions and the impact of recent state legislative developments enhancing transparency and enforcement
- Discuss the EEOC’s potential actions and/or enforcement strategies surrounding the PWFA and its final regulations
- Assess the EEOC’s pursuit of gender and race discrimination claims on behalf of white men
