Overview
Rachel Kessler helps employers prevent and resolve workplace disputes of all types. She supports clients through litigation, investigations, training, and day-to-day counseling to help minimize risk and address workplace concerns.
Rachel assists with disputes of all kinds, including claims of discrimination, harassment, retaliation, wrongful termination and breach of contract. She has worked on matters in federal and state courts, arbitration, mediation and administrative proceedings, as well as matters before the National Labor Relations Board. She also conducts investigations, including confidential internal matters and those arising from public complaints. Drawing on her experience with high-profile and sensitive litigations and investigations, Rachel understands the organizational stress workplace disputes can create and takes a practical, composed approach to resolution.
Beyond litigation prevention, Rachel provides guidance on everyday workplace issues, such as employee performance management, terminations, and structuring legally compliant intern and independent contractor roles. She also assists with training programs aimed at promoting compliance and reducing legal risk, and prepares managers to respond to union organizing campaigns.
Before joining Davis+Gilbert, Rachel was an employment litigation associate at Proskauer Rose.
