In this key conversation, Jessica Golden Cortes (Partner, Labor + Employment) will speak with Kenji Yoshino (Chief Justice Earl Warren Professor of Constitutional Law, New York University School of Law) in a deep dive on the June 29, 2023 Supreme Court of the United States (SCOTUS) decision to overturn Affirmative Action. Jessica and Kenji will discuss how the effects of this ruling are felt not only by educational institutions but also by businesses absorbing the downstream effects of racially unjust systems and structures that perpetuate unequal access to education and opportunities for historically marginalized populations. They will also discuss three other varieties of diversity and inclusion — debiasing work, ambient work and universal work — that Kenji believes can extend beyond typical affirmative action policies.
