Social media marketing spending is projected to hit $13.5 billion in 2017, and is estimated to account for almost 25% of all marketing budgets. But as marketing dollars go more and more towards this part of the media mix, there’s no avoiding the reality of associated legal dangers. The FTC has continued to pursue social media violations aggressively, with actions against Lord & Taylor, Ann Taylor LOFT, Sony, Warner Brothers and others, and claims for intellectual property infringement in this area abound. This session will expose the dangers inherent in social media marketing, and show retailers how to minimize risk. Topics covered will include the FTC’s Guides Concerning the Use of Endorsements and Testimonials and their impact on the use of social media, examples of copyright, trademark and right of publicity violations in social media, and creating best practices to ensure legal compliance for retailers, their employees and influencers.
