For financial institutions, banks and creditors, Nicolas Diefenbacher provides clarity in complex derivatives litigation stemming from bankruptcy matters. He also defends clients in asset-backed securities litigation, including RMBS, with a particular focus on the valuation of repurchase claims.

When clients seek to assert claims in bankruptcy-related derivative actions, Nicolas performs in-depth reviews of transaction documents and structures while analyzing pertinent laws. In RMBS litigation, he surveys the valuation of repurchase claims and establishes and evaluates settlement metrics to help clients develop favorable settlement terms.
Large European banks in particular appreciate that Nicolas is trained in French law and speaks French. Having lived and worked in France, he brings together stakeholders across various cultures and vantage points.
Before he joined Davis+Gilbert, Nicolas built a foundation of cross-border experience as an associate at Jones Day.
