Overview
Jack Schwartz is an experienced insurance lawyer offering the firm’s clients effective strategies they can use in all facets of their business, particularly in their contracts and agreements. Jack has spent the past 15 years deeply immersed in the insurance industry, including as coverage counsel and assistant general counsel at a brokerage.
A unique resource within a law firm setting, Jack offers clients valuable perspective into understanding insurance policies, their procurement and placement, coverage negotiation, and claims handling. He draws on his rare depth of technical knowledge to help position clients to address multilayered insurance concerns. Jack leads Davis+Gilbert Risk Management LLC, an insurance consultancy firm and wholly owned subsidiary of Davis+Gilbert.

With his knowledge of industry best practices, Jack explains complex insurance concepts, clarifies coverage terms, drafts and negotiates insurance clauses, and facilitates claims.
Jack’s unique background contributes to comprehensive client solutions. He frequently supports clients with the contractual requirements of transactions, for which he assists in drafting and negotiating pertinent clauses. He plays a key role in mergers and acquisitions by analyzing existing insurance coverage and its interplay with the transaction, He also identifies potential exposures to claims arising out of the transaction and outlines future coverage needs post-closing.
When litigation arises, Jack provides clarity on how and if insurance coverage applies and explains potential coverage issues. In real estate transactions, he helps landlords and tenants confirm their leases contain the right insurance requirements to provide proper coverage for both parties.
Representative Experience
Represent a national banking association in negligence and contract cases against a foreign bank, a retailer and a real estate owner involving property damage sustained by our client. Involved significant insurance and subrogation issues, several third parties and substantial motion practice in and out of court. Currently working to collect millions of dollars in judgment from several defendants after winning dismissal of one of the cases on the merits; the remaining cases are pending.
Guided a leading vertical software company in the insurance aspects of its acquisition of a full-scale SaaS marketing and data platform. Reviewed the client’s existing insurance policies, negotiated policy wording for representations and warranties insurance (RWI), and ensured the transaction would cause no gap in coverage.
Helped an owner, investor and partner negotiate and draft insurance requirements with lender and general contractor for an approximately $200MM construction project in downtown Manhattan. Coordinated with multiple consultants and parties to ensure the placement of adequate and appropriate insurance coverage and contractual compliance.
Guided the leading full line distributor of HVAC and Refrigeration systems and supplies in the Northeast United States in negotiation of insurance coverage and requirements related to the sale of company stock.
Assisted in negotiating and crafting the appropriate insurance policy to protect a client who was appointed manager in connection with a trust agreement relating to the bankruptcy of JC Penney.
