Medical Leave and Accommodation: Current Issues Under the FMLA and ADA

Many employers struggle to comply with their obligations under the Family and Medical Leave Act (FMLA), the Americans with Disabilities Act (ADA), and similar state laws. These difficulties have increased in recent years as statutes have been amended and courts have taken an increasingly pro-employee approach to interpreting these laws. Further complicating the matter is when these laws overlap, and when several laws may apply at the same time to the same situation. For example, there is a common misconception that a company may terminate an employee on medical leave once they have exhausted their FMLA leave.

This seminar will address several hot button issues regarding the FMLA and ADA, including:

  • The interplay between the FMLA and ADA
  • Accommodation issues such as dealing with mental health problems, alcohol/drugs and requests for companionship animals in the workplace
  • Dealing with doctors to confirm a disability and the need for accommodation
  • COBRA, the Affordable Care Act, and extended medical leaves: When does active coverage end?
  • "Quick Take" updates on ban-the-box legislation, LinkedIn issues, and paid sick leave laws, among other things
