Davis & Gilbert LLP Elects a New Partner, Counsel & Two Senior Attorneys

New York, NY, February 10, 2016 – Davis & Gilbert LLP is pleased to announce the election of Aaron Taylor to the Partnership, David Fisher to Counsel and Darren Fried and Lindsay Waiser to Senior Attorney effective January 1, 2016.

Aaron Taylor, Partner, is a member of the firm’s Advertising, Marketing & Promotions Practice Group. Mr. Taylor has broad experience in a range of intellectual property and media matters, including copyright, trademark, right of publicity and false advertising issues. Specifically, his practice involves counseling clients regarding the development and execution of multimedia advertising campaigns, challenging and defending cases before the National Advertising Division (NAD) of the Council of Better Business Bureaus, and assisting clients in litigation and regulatory proceedings that arise in the advertising/intellectual property arena. Among his notable recent accomplishments, Mr. Taylor successfully represented a major cosmetics company in a National Advertising Review Board (NARB) appeal that overturned the NAD’s decision that the company’s clinical study was not sufficiently reliable and could not support the company’s product performance claims. The NARB decision ensured that the company could continue to tout the results of its clinical study and promote its product’s impressive benefits. Mr. Taylor received his J.D. from Cornell Law School and his B.A. from Haverford College.

David Fisher, Counsel, is a member of the firm’s Labor & Employment Practice Group. He regularly advises clients with respect to a broad range of matters, including employment agreements, contract issues, terminations, reductions in force, wage and hour issues, sexual harassment investigations and the creation and implementation of personnel policies. In addition, he represents employers in federal and state court actions and before administrative agencies related to breach of contract, breach of fiduciary duty, restrictive covenants, and employment discrimination. In particular, Mr. Fisher has extensive experience advising on the development and enforceability of post-employment restrictions in jurisdictions throughout the United States. Mr. Fisher was recently involved in drafting the chapter “Employment Restrictive Covenants and Other Post-Employment Restrictions” in the Fourth Edition of the treatise Commercial Litigation in New York State Courts. Among his notable recent accomplishments, he successfully negotiated the settlement of multiple claims of discrimination and harassment, avoiding protracted litigation and its costs for his clients. Mr. Fisher received his J.D. from Cornell Law School and his B.S. from Cornell University’s School of Industrial & Labor Relations.

Darren Fried, Senior Attorney, is a member of the firm’s Advertising, Marketing & Promotions Practice Group. Mr. Fried's practice focuses on advising media companies, advertising agencies, music production companies, public relations agencies and advertisers in connection with entertainment, advertising, marketing and promotions law and intellectual property matters. He has extensive experience negotiating and drafting a broad spectrum of agreements such as for live events, music production, talent, sponsorships and content acquisitions. On a daily basis, Mr. Fried works closely with his clients’ commercial and creative teams to provide counsel on all aspects of contract interpretation and intellectual property rights. He also frequently reviews advertising for FTC and competitor challenges, watchdog review and consumer complaints to help agencies and advertisers manage risk while balancing legal and commercial considerations. Mr. Fried received his J.D. from Harvard Law School, and his B.A. from Queens College (CUNY).

Lindsay Waiser, Senior Attorney, is a member of the firm’s Corporate Practice Group. She is involved in all aspects of the corporate practice, with an emphasis on mergers and acquisitions. Ms. Waiser frequently represents individuals in connection with the formation or sale of their businesses and counsels clients on structuring and negotiating shareholder and limited liability company agreements. She also assists clients in negotiating employment and non-competition agreements, confidentiality agreements and other general corporate matters. Ms. Waiser received her J.D. from New York Law School and her B.B.A from Emory University’s Goizueta Business School.
