Davis & Gilbert LLP Elects Shira Franco & Matthew E. Smith to the Partnership

New York, January 8, 2015 – Davis & Gilbert LLP is pleased to announce the election of Shira Franco and Matthew E. Smith to the partnership, effective January 1, 2015.

Shira Franco is a member of the firm’s Labor & Employment Practice Group. Ms. Franco has extensive experience litigating a broad range of employment disputes, including claims of discrimination, harassment, and retaliation, breach of contract, and violations of wage and hour laws. She advises companies in a variety of industries, with a particular emphasis on financial services, technology, restaurant and hospitality, advertising and marketing, public relations, construction management, and real estate management. A strong focus of her practice involves representing hedge funds, investment banks, accounting firms, and other financial industry employers in litigating claims related to bonus payments and other compensation arrangements and violations of non-compete, non-solicitation, and confidentiality agreements. Ms. Franco’s notable recent accomplishments include winning dismissal on summary judgment of a complex multimillion dollar breach of contract case on behalf of a global investment management firm. In addition, she regularly advises and trains clients on a wide array of workplace issues, including harassment prevention, employee performance management, internal investigations, and human resources best practices. Ms. Franco received her J.D., cum laude, from Harvard Law School, and her A.B., with highest distinction, from the University of California, Berkeley.

Matthew E. Smith is a member of the firm’s Advertising, Marketing & Promotions Practice Group. Mr. Smith represents agencies, media companies and marketers on all aspects of advertising, promotions, marketing and entertainment. He has significant experience counseling on matters subject to heightened regulation, including alcoholic beverages, automotive, telecommunications, charitable tie-ins, lotteries, casino gaming, and environmental benefit claims, as well as on matters specific to certain media, such as mobile marketing, text-message marketing, e-mail marketing, telemarketing, and direct mail. Additionally, he has extensive knowledge in the area of consumer promotional offers and programs and regularly advises clients on all forms of regional, national and trans-national games of chance, skill contests, rebate programs, giveaways, coupons, gift cards, loyalty programs. A particular focus of his practice also involves working closely on matters relating to marketing and advertising to the Hispanic community. His recent work on global and high-profile advertising campaigns includes working with the global creative agency for Chevrolet on the development and production of advertising and promotional campaigns tied to Chevrolet’s sponsorship of the Sochi 2014 Winter Olympics. Mr. Smith received his J.D. from George Washington University Law School, J.D., with honors, his Masters of International Affairs from George Washington University Elliott School of International Affairs, and his B.A. from University of Massachusetts, cum laude.
