Davis & Gilbert Litigation Partners Publish Restrictive Covenants Chapter in "Commercial Litigation in New York State Courts"

New York, October 27, 2010 - Davis & Gilbert announced today that the publication Commercial Litigation in New York State Courts has featured a chapter, "Employment Restrictive Covenants and Other Post-Employment Restrictions" written by Michael C. Lasky and Neal H. Klausner, partners in the firm's Litigation Practice Group

Commercial Litigation in New York State Courts, now in its third edition, is widely recognized as the definitive, six-volume treatise for procedural and substantive legal issues in New York commercial litigation practice. This publication includes chapters authored by 20 distinguished judges, including in this edition the Chief Judge of the State of New York, justices from the New York State Court of Appeals and Appellate Division, the Commercial Division of the New York Supreme Court, and the federal courts in New York.  Authors also include the "cream of the commercial litigation bar," and partners at such other top litigation firms as Paul, Weiss, Rifkind, Wharton & Garrison LLP; Cravath, Swaine & Moore LLP; and Cleary Gottlieb Steen & Hamilton, according to Robert L. This chapter, authored by Mr. Lasky and Mr. Klausner, discusses the use and enforcement of restrictive covenants in employment agreements, various covenants and their purposes and how to prevent unfair competition by a former employee.  The chapter reviews factors to consider when deciding to enforce a restrictive covenant through litigation, practical and strategic considerations and pre-litigation steps.  It also analyzes various claims, defenses and remedies that typically arise in restrictive covenant litigation, and includes practical tips, model checklists and sample forms of agreements and policies.

The first and second editions of this treatise have been recognized as invaluable resources and have become the definitive reference works in their field.  Both the first and second editions received an enthusiastic reception from the legal press, reflected in more than 50 favorable book reviews in bar journals and legal newspapers.  According, to Mr. Haig in the foreword to this new edition, "it is an idea book filled with nuggets of wisdom and perspective that could only have been gained by years of experience in handling cases from the most simple to the most complex."
