We recently defended McKinney & Silver and Audi of America in a complex copyright case through trial, and now in the Eighth Circuit Court of Appeals, arguing that the Eighth Circuit should uphold the trial judge's decision refusing to permit an award to plaintiff of Audi's profits.
We represented MTD Products in Deere & Company v. MTD Products, Inc., one of the leading trademark dilution cases.
We successfully defended use of name "Prolamine" from claim by "Polaramine" in Schering Corp. v. Thompson Medical, where even the judge was repeatedly confused.
We successfully represented Weight Watchers International, in a pivotal trademark infringement case establishing Weight Watchers as a protectible trademark worldwide.
We successfully represented St. Regis Publications in CES Publishing Corp. v. St. Regis Publications, Inc., an oft quoted trademark decision holding for our client that the name "Consumer Electronics" was generic for a magazine and that the issue of secondary meaning was irrelevant since by definition a generic term can never acquire secondary meaning.
We litigated the first Trademark Office case testing the "intent" provision of the intent-to-use filing system.
We represent numerous advertising music production companies on issues concerning music copyright clearance, licensing and other music-related intellectual property issues.
We successfully defended the use of the word "Roctober" by our client ABC as generic in a trademark infringement case. |
