False Advertising & Deceptive Marketing Practices: Trends in Consumer Class Actions and Governmental Enforcement Actions

Governmental agencies have stepped up enforcement activities against consumer products manufacturers and advertisers. Because class action plaintiff attorneys monitor FTC and state attorney general settlements to identify potential new cases, the enhanced enforcement activity has resulted in an increase in consumer class actions against national advertisers. This informative seminar will address recent trends in governmental investigations and consumer class actions, as well as important considerations to keep in mind during the resolution phase. This program will also include a guest speaker from the FTC.

Specifically, this program will cover:

  • Trends in the types of advertising that have sparked investigations and class actions, including health benefit claims, clinically proven claims, negative option marketing and other disclosure issues
  • Confidentiality and discoverability considerations
  • Third party subpoenas
  • Practical tips for efficient resolution
