The Contingent Workforce: Legal Issues Related to Temps, Consultants, Freelancers, Interns, and other “Non-Regular” Personnel

As the workplace continues to change and evolve, many companies routinely engage “non-regular” workers such as freelancers, temps, on-call employees, consultants, interns, and leased employees in addition to full-time and part-time “regular” employees. In addition, companies are implementing non-salary compensation arrangements, work-from-home policies, and alternative work schedules.

Engaging “non-regular” workers raises numerous legal questions related to compensation, benefits, offer letters, performance management and termination. Employers also need to carefully consider the impact of the Affordable Care Act’s employer mandates (effective in 2014) and whether any special rules apply to non-regular personnel with respect to health benefits.

This seminar will provide a comprehensive discussion of applicable laws and best practices related to the contingent workforce, including:

  • Legal risks associated with independent contractors and interns
  • Joint employer risks when workers are employed and placed by staffing agencies
  • Flex-time schedules and work-from-home arrangements
  • Alternative pay arrangements such as day rate and fee per job
  • Benefits issues related to “non-regular” personnel
