American Conference Institute’s FDA & USDA Compliance Boot Camp

Jennifer B. Soussa, Davis & Gilbert Advertising, Marketing & Promotions Counsel, will speak during the session “Marketing and Advertising: What Can and Cannot Be Said When Crafting Health, Nutrition, Benefit, Function and Mental Performance Claims” during ACI’s FDA & USDA Compliance Boot Camp.

Ms. Soussa and her co-panelists will discuss product claims and claim substantiation. Some of the issues to be addressed include:

  • Delineating the various types of food and beverage product claims
  • Distinguishing under what circumstances a health claim that has been cleared through FDA’s pre-market clearance procedures can be deemed unauthorized under the FDCA
  • Evaluating the evolution of the standard used by the FTC to assess claim substantiation
  • Joint enforcement activity in food and beverage marketing and advertising
