American Conference Institute’s National Forum on Defending and Managing High Exposure Claims of Retaliation and Discrimination

Gregg Brochin, Davis & Gilbert Labor & Employment Partner, will speak at a session titled "Sexual Harassment Claims: Minimizing Conduct or Showing That It Had No Effect On The Discriminatee" during ACI's National Forum on Defending and Managing High Exposure Claims of Retaliation and Discrimination at the Helmsley Park Lane Hotel in New York.

Some of the issues Mr. Brochin and his co-presenters will discuss include:

  • What conduct is now "severe or pervasive" in the eye of the jury
  • Hostile Work Environment: recent changes that make it more difficult for employers to defend against them, at least at the summary judgment stage
  • Sexual harassment claims where the relationship was apparently consensual at the beginning but then changed
  • Defending against claims when a key executive is the alleged perpetrator or there are allegations of physical abuse
  • Tag-on state statutory claims involving violence against women
