Jennifer B. Soussa is counsel in the Entertainment, Media & Publishing; Advertising, Marketing & Promotions and Technology, Digital Media & Privacy Practice Groups of Davis & Gilbert. She represents entertainment companies, media companies, advertising agencies, public relations firms and advertisers in connection with all areas of entertainment, publishing, advertising, marketing and promotions law.
Ms. Soussa's advertising, marketing and promotions practice extends from providing advice on the content of advertising copy and public relations materials, to negotiating complex agreements relating to the advertising, marketing and promotions industry. On behalf of both advertisers and agencies, she is regularly involved in the drafting and negotiating of a wide variety of agreements including agency-client, sponsorship and talent, publishing, joint venture, web development, blogger/brand ambassadors, distribution, commercial production, and sports and software license agreements. Ms. Soussa also advises clients with respect to the protection, maintenance and licensing of copyrights and trademarks and trade secrets and provides consultation on state and federal regulatory matters relating to telemarketing, children’s advertising issues, privacy issues, direct mail, sweepstakes, skills contests, charitable solicitations, false advertising, and endorsement and testimonial issues.
In her entertainment, media and publishing practice, Ms. Soussa has advised and represented record labels, media companies, writers, wireless service providers and Internet companies in all aspects of entertainment and media. Her practice regularly involves acquisitions of music and literary properties, motion picture and video footage, as well as negotiating entertainment content and music distribution agreements, talent and spokesperson contracts, as well as interactive, wireless, software and other technology licenses.
Ms. Soussa also works closely with clients on matters relating to food and drug marketing, with an emphasis on food/beverage products and dietary supplements. She regularly counsels food and drug clients on issues regarding ingredients and additives, labeling, claims and claim substantiation, and helps navigate complex regulatory requirements issued by the FDA, FTC and USDA.
Before joining Davis & Gilbert, Ms. Soussa was an intellectual property & new media attorney at Weil, Gotshal & Manges, LLP.

- Regularly represents one of the world’s largest advertising holding companies in connection with advertising, marketing and promotions contracts with global clients.
- Represented Sanofi Pasteur in connection with a nationwide charitable sales promotion on behalf of AmeriCares.
- Represented a major dietary and weight loss plan company in the development of advertising and branding for the launch of the company’s new diet food product line.
- Counseled the developer of a new coconut water on launch issues, including review and revisions to product labeling and claims.
- Advised a large food manufacturer on potential modifications to the current standard of identity for dairy food products marketed in the U.S.
- Drafted and negotiated celebrity talent agreements on behalf of a major consumer electronics company.
- Negotiated music download, ringtone and ring back tone content agreements for a large wireless service provider.
