Gerald B. Schwartz is co-chair of the Advertising, Marketing & Promotions Practice Group and a member of the Intellectual Property, Technology, Digital Media & Privacy Practice Groups of Davis & Gilbert. Mr. Schwartz has extensive experience in the practice known as “advertising law”, as well as the drafting and negotiation of a wide variety of commercial agreements and licensing agreements, particularly those relating to intellectual property.
Mr. Schwartz has been recognized by Chambers USA 2010: America's Leading Lawyers for Business, making this the fourth consecutive year he has been recognized by the legal directory. Mr. Schwartz is admired by his clients for his ability to “negotiate hard and get deals done.” In addition, he has also been recognized as one of The Best Lawyers in America in advertising law (2013).
In the area of advertising, he is regularly involved in the review of all forms of advertising, dealing with issues such as claim substantiation, false advertising, demonstrations, guarantees, testimonials and copyright and trademark matters, as well as the negotiation and preparation of contracts dealing with media, talent, music, commercial production, agency-client contracts and licensing of third party rights. He has a particular expertise in the application of New York State sales tax to advertising materials and has maintained a substantial involvement in the area of infomercial advertising.
In addition, Mr. Schwartz also advises corporations and individual executives in connection with business formation and structure, shareholder arrangements, employment arrangements, licensing agreements, non-competition agreements and a wide variety of general business transactions.
