Oriyan Gitig is counsel in the Advertising, Marketing & Promotions; Digital Media, Technology & Privacy; Entertainment, Media & Sports; and Intellectual Property Practice Groups of Davis & Gilbert. Ms. Gitig’s practice includes drafting and negotiating contracts and counseling clients in the areas of privacy and data protection, new media, technology and software development and licensing, advertising and intellectual property. In the privacy area in particular, Ms. Gitig advises clients with regard to their internal privacy and information security practices as well as consumer-facing privacy disclosures, and assists clients in negotiating contracts to protect their data resources and maintain the confidentiality of their information security practices. She also advises clients and negotiates agreements pertaining to compliance with privacy laws, regulations and industry standards, such as the Children’s Online Privacy Protection Act, Gramm Leach Bliley Act, FTC privacy principles and recommended practices.

Ms. Gitig also represents global and domestic companies in connection with the many aspects of advertising, social media, marketing, new media and entertainment, including advising clients in connection with intellectual property matters, the rights of privacy and publicity and false advertising, among other areas. Her practice extends from providing counsel to both agencies and advertisers, as well as other media and entertainment companies, with regard to their promotional and other creative materials (including digital and interactive content), to negotiating a wide variety of complex agreements, including agency-client, data handling, development, licensing, production, strategic alliance, sponsorship and joint venture. Ms. Gitig regularly provides counsel to her clients in connection with online and social media matters generally, including with respect to privacy and user generated content.

Ms. Gitig has represented clients in a variety of industries, including media, entertainment, fashion, winemaking, not-for-profit, real estate, pharmaceutical and financial services.

Ms. Gitig is a Certified Information Privacy Professional (CIPP). In recognition of her achievements, she was selected as a Rising Star by New York Metro Super Lawyers (2014-2016). Prior to joining Davis & Gilbert, Ms. Gitig was an intellectual property and media attorney at Weil, Gotshal & Manges LLP.

  • Negotiated digital content license agreements on behalf of a major cable network. 
  • Represented a human rights non-profit organization in the settlement of an intellectual property dispute with former employee.

  • Negotiated intellectual property terms in connection with an asset purchase agreement for a large global cosmetic and skin-care conglomerate.
