Regulatory

Since its founding, Davis & Gilbert has been extensively involved in the representation of clients before Federal, state, local and self-regulatory bodies, concerning rules and regulations which affect advertising, marketing and promotions.

Federal Trade Commission, State Attorneys General, U.S. Postal Service and Other State and Federal Agencies

Our experience in this area includes:

• Defending numerous advertisers and agencies before the FTC and the states

• Handling leading edge joint FTC and multi-state Attorney General actions

• Participating with the FTC in numerous official FTC industry programs across the country

• Defending advertising actions at the county and city level in the states

• Litigating key industry issues before the FTC

Food, Drugs and Cosmetics

One of our partners is a registered pharmacist, a former Federal Trade Commision trial counsel and a former FTC coordinator with the Food and Drug Administration. Under his expert guidance, our broad range of food, drug and cosmetic related legal services include:

• Advising on statutes and regulations governing the marketing, advertising, and labeling of foods, drugs, cosmetics and medical devices

• Representing clients before the FDA, including defense of clients whose products have been seized for alleged misbranding

• Preparation, submission, and monitoring of new drug applications for over-the-counter drugs throughout the FDA approval process

• Providing advice in connection with FDA inspections of clients' manufacturing facilities

• Advising and representing clients in their dealings with the United States Customs Service over the labeling and possible adulteration of their products

• Assisting foreign clients with the introduction of their products into the U.S. market
