Advertising

Davis & Gilbert has the largest advertising law practice of any law firm in the world today. We handle all of the legal needs for global holding companies, national agencies, midsize creative shops, national, regional and local advertisers, small start-ups and more. With a full century of advertising expertise, we work closely with the AAAA, and were responsible for many of the forms and procedures in use today, such as the standard agency/client form which is now recommended. Davis & Gilbert is also counsel to the IAB, and is frequently called upon for advice and counsel by the ANA and AAF.

The following are some of the many areas in which we counsel and serve our clients:
• Provide copy review and advice from idea through production

• Handle entire network clearance process and submissions

• Draft, review and negotiate all types of agreements and forms including: agency-client contracts, talent and commercial production agreements, music and other rights licenses and media purchase and insertion orders

• Handle violations of rights of privacy/publicity

• Defend and bring unfair competition claims, including Lanham Act claims

• Handle comparative advertising challenges

• Supervise compliance with Federal, state and local governmental regulations (see the Regulatory section for more detail)

• Represent clients before industry self-regulatory bodies (National Advertising Division of the Council of Better Business Bureaus and NAD's Children's Advertising Review Unit) and each of the broadcast networks

• Audit client's advertising compliance process

• Formulate policies, implement procedures and develop customized training sessions to avoid violations of law

• Handle all of the needs of specialized agencies, such as direct marketing, design, interactive, media, medical, and others
